From 12 to 16 October 2026, the Thai delegation, comprising representatives of the Ministry of Foreign Affairs (the Department of International Economic Affairs and the Department of Treaties and Legal Affairs) and the Office of the Attorney General, attended the 55th Session of the United Nations Commission on International Trade Law (UNCITRAL) Working Group III on Investor-State Dispute Settlement (ISDS) Reform at the Vienna International Centre, Austria. The Working Group considered draft provisions on procedural and cross-cutting issues, including consolidation of claims, regulation of third-party funding, recourse to local remedies, waiver of parallel proceedings, limitation periods, shareholder claims, the right to regulate, assessment of damages, and joint interpretation. Agreement was reached on a number of provisions, with a view to their submission to the Commission in 2027.

The Thai delegation delivered statements on key issues, including support for a time limit on consolidation requests, preserving the respondent State’s right to appoint an arbitrator, regulating third-party funding in a manner that balances investors’ access to justice with the integrity of proceedings, and recognising States’ right to regulate in pursuit of legitimate policy objectives. These positions are reflected in the provisions agreed by the Working Group.

Following developments in international investment law in this forum directly supports Thailand’s negotiation of free trade agreements (FTAs) and bilateral investment treaties (BITs). The agreed provisions are set to become international reference standards, which Thailand can draw upon in the investment chapters of ongoing FTA and BIT negotiations to reduce the risk of parallel claims and disproportionate damages, while protecting Thai investors abroad.

On the margins of the session, the Thai delegation also met the Canadian delegation to discuss the investment chapter of the Thailand–Canada FTA, and followed up on deliberations on the headquarters location of the Advisory Centre on International Investment Dispute Resolution, for which Thailand has proposed Bangkok.
